Sale Method: Property will be offered as 1 parcel. All bids are open for advancement until the auctioneer announces that the real estate is sold. All decisions of the auctioneer are final.
Earnest payment: A 10% NON-REFUNDABLE earnest money payment is required on the day of the auction. The earnest payment rendered shall be made in the form of cash or check. All funds will be held in the John Herrig Realty Trust Account.
Minerals: All mineral interest owned by the seller will be conveyed to the buyer.
Property taxes: Sellers to pay all real estate property taxes pro-rated to closing date.
Conditions: This sale is subject to all easements, covenants, restrictions of record, and leases. Each bidder is responsible for conducting, at their own risk, their own inspections, inquiries, and due diligence concerning the property. The properties and their fences are sold on an AS IS, WHERE IS basis with no warranties or guarantee, either expressed or implied by the seller, John Herrig Realty, or Jess Herrig Auction & Realty.
Contract and title: Immediately upon conclusion of the auction, the highest bidder(s) will enter into a real estate contract and deposit with John Herrig Realty the required earnest payment. Sale is not contingent upon buyer financing. Final sale is subject to the approval of the seller. The seller will provide an updated abstract at their expense.
Closing and possession: Closing on or about July 31, 2015. Crop ground is subject to current tenants rights through March 1, 2016.
